Please read these Terms and Conditions ("Terms," "Terms of Service") carefully before using the Zobiki website and the Zobiki Software as a Service (SaaS) platform (the "Service"), operated by Sideos Lab UG ("us," "we," or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Definitions
- Service or Platform: Refers to the Zobiki Software as a Service platform, including all related features, content, applications, and services provided by Sideos Lab UG.
- Company: Refers to Zobiki, operated by Sideos Lab UG.
- User/You/Your: Refers to the individual or entity that has created an account to use the Service.
- Subscription: Refers to the paid, non-exclusive, non-transferable license to access and use the Service for a specified term, typically an annual period.
2. License and Access
2.1 License Grant
Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your internal purposes during the Subscription term.
2.2 Restrictions on Use
You agree not to, and you will not permit others to:
- Modify, adapt, translate, or create derivative works based on the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
- Use the Service to transmit any material that contains software viruses, harmful computer code, files, or programs.
- Use the Service in any manner that violates any applicable local, state, national, or international law or regulation.
3. User Accounts
3.1 Account Creation and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately upon becoming aware of any unauthorized use of your account.
3.2 Accuracy of Information
You agree to provide true, accurate, current, and complete information when registering for the Service and to maintain and promptly update your account information.
4. Billing, Payments, and Refunds
4.1 Subscription and Payment
The Service is billed on an annual subscription basis. By purchasing a Subscription, you agree to pay the annual fee specified at the time of purchase. All payments must be made in advance. For refund see below Refund Policy
4.2 Automatic Renewal
Your Subscription will automatically renew at the end of each annual term unless you cancel the renewal prior to the renewal date. You authorize us to charge your designated payment method for the renewal subscription fee.
The Service and its original content, features, and functionality are and will remain the exclusive property of Sideos Lab UG and its licensors. The Service is protected by copyright, trademark, and other laws of both the Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sideos Lab UG.
5 Termination
We may terminate or suspend your account and deny access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation, a breach of the Terms. If you wish to terminate your account, you may discontinue using the Service and cancel your renewal as per the terms in Section
Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.
6. Limitation of Liability
In no event shall Sideos Lab UG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

REFUND POLICY
This Refund and Cancellation Policy outlines the terms for seeking a reimbursement for your annual subscription to the Zobiki Platform. By purchasing an annual subscription, you acknowledge and agree to these terms.
1. General Principle
Due to the nature of our Software as a Service (SaaS) license model and the substantial discount offered for an annual prepayment, all subscription fees for annual plans are non-refundable after the initial satisfaction guarantee period except for service failure.
2. Initial Satisfaction Guarantee period
We offer a free account to test the service before your initial purchase. Once you move to a paid plan the subscription fee is non-refundable.
3. Exceptions (Service Failure)
A refund may be issued only if Zobiki fails to provide the service as described (e.g., extended platform downtime outside of scheduled maintenance or removal of core features). Refunds for service failure will be handled on a case-by-case basis and, if granted, will be calculated as a prorated refund for the period during which the service was demonstrably unavailable.
5. How to Initiate a Request
To request a cancellation and/or refund:
- Send a clear written notice via email to support@zobiki.com with the subject line: "Annual Subscription Cancellation/Refund Request."
- Include your full name, the email address associated with your account, and the date of your purchase
- State the reason for your request (required for internal feedback purposes only).
6. Refund Processing
If your refund request is approved:
- Timing: Refunds will be processed within few business days of approval.
- Method: All refunds will be issued back to the original payment method used for the purchase.
